Vicki Momberg does not qualify for a reduced sentence, but the AbaThembu king jailed for violent crime is eligible

Real estate agent Vicki Momberg was sentenced to an effective two-year imprisonment for racist remarks to police and emergency services when she sought help after she was the victim of theft in North Riding in February 2016. The incident is on camera trapped.

Although the authenticity of Momberg’s words is undeniable, her sentence is surprising. A first offender convicted of crimen injuria will usually be sentenced to a fine and suspended jail on condition that the offender does not re-offend

The King does, but Momberg doesn’t?

Criminal Law Attorney Ulrich Roux was not impressed by Ramaphosa’s Christmas gift to many prisoners. Ramaphosa announced on Monday during Reconciliation Day in Bergville, KwaZulu-Natal, that the punishment of certain categories of sentenced offenders will be reduced.

More than 14,000 convicts will be free as birds after Ramaphosa approved amnesty and pardon

President Cyril Ramaphosa has approved the release of 14,647 offenders on pardons and remissions to mark Reconciliation Day.

On Monday, Ramaphosa granted a special remission of sentence to specific categories of sentenced offenders, probationers and parolees.

“Remissions of sentences are always carefully considered, taking into account the interests of the public and the administration of justice. We recognise that incarceration has followed a judicial process and that sentences have been duly imposed after conviction,” the president said.

Justice Minister Ronald Lamola said the process would start immediately and may take up to nine months.

The pardons will not include offenders sentenced for sexual offences, murder and attempted murder, armed robbery, mentally-ill sedition, high treason, sabotage and terrorism.

The president says for South Africa to strive for equality there needs to be expropriation of land without compensation – But what about all the land you own Mr President?

President Cyril Ramaphosa says reconciliation is depended on resolving land disputes in the country.

Ramaphosa delivered the key note address to hundreds of people in Umtata at the official Reconciliation Day commemoration on Sunday.

The president says for South Africa to strive for equality there needs to be expropriation of land without compensation.

“Far from being a measure that will fuel tensions or set race relations back, accelerated land reform has the potential to improve goodwill between the people of our country.”

Ramaphosa says the land issue must be resolved.

“Most of the country’s land remains in the hands of a few people in our country. but we must consider that failure to resolve the land issue will threaten the stability of our democratic nation.”

Parliament recently adopted a report recommending the amendment of section 25 of the Constitution to expropriate land without compensation.
